CONDUCT RULES FOR THE RESIDENTS, VISITORS AND EMPLOYEES OF RUYTEPLAATS PRIVATE MOUNTAIN ESTATE ISSUED BY THE RUYTEPLAATS HOMEOWNERS ASSOCIATION AND THE RUYTEPLAATS MOUNTAIN LODGES BODY CORPORATE.

DEAR RESIDENT

TO FACILITATE THE OPERATION, MAINTENANCE AND ENJOYMENT OF THE ESTATE BY ALL WHO LIVE HERE, THE TRUSTEES WISH TO DRAW TO YOUR ATTENTION THE GENERAL RULES AND REGULATIONS OF THE ESTATE.  THESE SHOULD BE READ IN CONJUNCTION WITH THE RUYTEPLAATS HOMEOWNERS’ ASSOCIATION CONSTITUTION AND THE RUYTEPLAATS PRIVATE ESTATE DESIGN MANUAL, AND FOR LODGES RESIDENTS THE RULES OF THE BODY CORPORATE.

PLEASE NOTE THAT THE ONUS IS ON HOUSE AND LODGE OWNERS TO ENSURE THAT TENANTS AND VISITORS ARE ADVISED OF, AND ABIDE BY, THESE RULES.

PENALTIES:
  • ESTATE MANAGEMENT WILL GIVE A VERBAL WARNING FOR THE FIRST OFFENCE.
  • ESTATE MANAGEMENT WILL ISSUE A WRITTEN WARNING WITH A PENALTY OF R500 FOR THE SECOND OFFENCE IF IT OCCURS WITHIN 6 MONTHS OF THE FIRST OFFENCE.
  • ESTATE MANAGEMENT WILL DOUBLE THE PENALTY FOR EACH OFFENCE THEREAFTER IF IT OCCURS WITHIN 6 MONTHS OF THE PREVIOUS OFFENCE.
  • IF MORE THAN 6 MONTHS HAVE PASSED SINCE THE LAST OFFENCE THEN THE PENALTY PROCEDURE WILL START WITH STEP 1 ABOVE.
 
RULE 1: FIRE PREVENTION
  1. NO OPEN FIRES ARE ALLOWED ON RUYTEPLAATS PRIVATE OPEN SPACE AREAS.
  2. ALL BRAAI'S / FIRES ON PRIVATE PROPERTY MUST BE ATTENDED AT ALL TIMES.
  3. BURNING OF GARDEN REFUSE IS STRICTLY NOT PERMITTED.
RULE 2:  HOUSEHOLD REFUSE
  1. NON RECYCABLE HOUSEHOLD REFUSE
  2. NO LITTERING ANYWHERE ON THE ESTATE.
  3. HOUSEHOLD REFUSE MUST BE KEPT OUT OF VIEW EXCEPT ON THE MORNING OF COLLECTION
  4. COLLECTION OF HOUSEHOLD REFUSE IS AT 08H00 ON THURSDAYS,  EXCEPT FOR PUBLIC HOLIDAYS WHEN IT WILL BE COLLECTED THE FOLLOWING WORKING DAY.
  5. HOUSEHOLD REFUSE MUST BE PLACED ON YOUR ROAD VERGE IN SEALED BLACK BAGS.   LODGE REFUSE WILL BE COLLECTED FROM THE YARDS.
  6. ONLY BLACK BAGS WILL BE ACCEPTED FOR HOUSEHOLD REFUSE. DO NOT USE RECYCLING BAGS FOR NON-RECYCABLE HOUSEHOLD REFUSE.
RECYCLABLE HOUSEHOLD REFUSE E.G. PLASTIC, PAPER, CARDBOARD, GLASS AND TIN
CLEAR RECYCLABLE BAGS ARE PLACED IN RESIDENTS POST BOXES AND ARE AVAILABLE FROM SECURITY.
THE COLLECTION PROCEDURE IS THE SAME AS FOR HOUSEHOLD REFUSE.
 
RULE 3: GARDEN REFUSE
  1. GARDEN   REFUSE  COLLECTION  DAYS  ARE  MONDAY  TO  THURSDAY.  NO  COLLECTION  ON  FRIDAYS.
  2. GARDEN  REFUSE  MUST BE KEPT OUT OF VIEW EXCEPT ON THE DAY OF COLLECTION.
  3. GARDEN  REFUSE  MUST  BE  PUT  OUT  ON  YOUR  ROAD  VERGE  BEFORE  14H00  ON  COLLECTION  DAYS.
  4. GARDEN  REFUSE  MUST  BE  PLACED  IN  SEALED  GREEN  BAGS.  NO RECYCLING BAGS OR BLACK BAGS ARE ACCEPTED FOR GARDEN   REFUSE.
  5. PINE  NEEDLES  AND  LEAVES  ARE  TO  BE  IN  SEPARATE  GREEN  BAGS  TO  GRASS  AND  SOFT  CUTTINGS. 
  6. BRANCHES   AND   STICKS   MUST   BE   CUT   UP   AND   LEFT   IN   BUNDLES   NOT   LONGER   THAN   1   METER.
  7. ONLY 4  GREEN  BAGS  A  DAY  WILL  BE  ACCEPTED,  FOR  LARGER  LOADS  THAN  THIS  PLEASE  CONTACT  THE  OFFICE  FOR  ALTERNATIVE ARRANGMENTS  021 790 6206.
  8. ANY  GARDEN  SERVICES  OR  LANDSCAPERS  DOING  WORK  FOR  YOU  MUST  REMOVE  ANY  REFUSE  THAT  THEY  GENERATE. THIS SHOULD  BE  PART  OF  THE  AGREED  CONTRACT  WITH  YOU.
  9. NO GARDEN REFUSE  WILL  BE  COLLECTED  ON  PUBLIC  HOLIDAYS.
RULE 4: MAINTENANCE OF VACANT PLOTS
  1. PLOTS MUST BE KEPT NEAT AND FREE OF INVASIVE ALIEN PLANTS AND LITTER.  WHERE AN OWNER FAILS TO COMPLY, THE TRUSTEES WILL ARRANGE TO HAVE THE ALIEN VEGETATION REMOVED AT THE COST OF THE OWNER.
  2. NO CAMPING, TEMPORARY ACCOMMODATION OR OPEN FIRES ALLOWED.
RULE 5: PETS
  1. DOGS MUST NOT ROAM FREELY ON THE ESTATE.  ALL DOGS ON PRIVATE OPEN SPACE MUST BE ACCOMPANIED ON A HAND HELD LEASH.
  2. YOU MUST INSTANTLY REMOVE YOUR DOGS’ DROPPINGS IN COMMON AREAS.
  3. PETS SHOULD NOT CAUSE A NUISANCE TO OTHER RESIDENTS.
  4. PETS SHOULD NOT CAUSE DAMAGE TO ESTATE PROPERTY.
  5. NO ANIMALS ARE ALLOWED IN THE LODGES. REFER TO THE REGISTERED LODGES BODY CORPORATE CONDUCT RULES.
NOTE : THE CONSTITUTION PARAGRAPH 8.3.15 STATES:  “DOGS AND OTHER HOUSEHOLD PETS MAY BE ALLOWED AT THE SOLE DISCRETION OF THE TRUSTEES WHO MAY WITHDRAW  SUCH CONCESSION UPON WRITTEN NOTICE.” THE TRUSTEES INTEND TO FULLY ENFORCE THIS IN THE CASE OF DANGEROUS ANIMALS, OR SEROIUS BREACH OF THE ABOVE RULES.
 
RULE 6: TRAFFIC RULES
  1. THE SPEED LIMIT IS 30 KM/HR AND MUST BE STRICTLY ADHERED TO AT ALL TIMES. 
  2. PARKED VEHICLES MUST NOT OBSTRUCT TRAFFIC, DRIVEWAYS OR ACCESS ROADS.
  3. ALL OTHER GENERAL TRAFFIC RULES AND BY-LAWS APPLY.
  4. ANY VEHICLE LEAKING OIL CAN BE DENIED ACCESS TO THE ESTATE FOR OBVIOUS REASONS.
  5. MOTORISED VEHICLES ARE ONLY PERMITTED ON BRICK PAVED ROADS.
  6. RECKLESS DRIVING IS NOT CONDONED AND WILL INCUR FINES.
  7. NO MOTORISED VEHICLES, EXCEPT FOR ESTATE VEHICLES, ARE ALLOWED ON PRIVATE OPEN SPACE, PATHWAYS OR ESTATE ACCESS ROADS.
  8. HORSES MUST ONLY WALK, NOT TROT, CANTER OR GALLOP, AND ONLY ALONG THE THOMAS BAINES SERVITUDE WITHIN THE ESTATE BOUNDARIES AND DROPPINGS MUST BE CLEANED UP.
  9. NO VEHICLES TO PARK OR STOP ON THE FIRE BREAK PATHS, AT ANY TIME.
RULE 7: TREES, GARDENS AND FENCES
  1. NO INVASIVE ALIEN SPECIES MAY BE PLANTED OR CULTIVATED IN GARDENS AND MUST BE REMOVED IF PRESENT.   IF IN DOUBT PLEASE CONTACT THE ESTATE MANAGER WHO WILL ADVISE AND ASSIST YOU.  INDIGENOUS PLANTING IS RECOMMENDED.
  2. ANY RESIDENT WANTING TO FELL A TREE, INCLUDING ON PRIVATE OPEN SPACE, MUST CONTACT THE ESTATE MANAGER BEFOREHAND FOR THE TREE FELLING PROCEDURE GUIDELINES.
  3. RESIDENTS ARE NOT PERMITTED TO LANDSCAPE PRIVATE OPEN SPACE WITHOUT PRIOR WRITTEN CONSENT OF THE TRUSTEES.  LIMITED PLANTING BY RESIDENTS IN THESE AREAS MAY BE PERMITTED FOR THE BENEFIT OF ALL, SUBJECT TO THE WRITTEN APPROVAL OF THE TRUSTEES.  THE FOLLOWING CONDITIONS APPLY :
    a. THERE MUST BE A CLEAR AND WRITTEN UNDERSTANDING THAT THE LAND BELONGS TO THE ESTATE.
    b. ONLY INDIGENOUS PLANTS AND TREES MAY BE USED.
    c. THE CONTOUR OF THE LAND MAY NOT BE ALTERED.
    d. THE TRUSTEE RESPONSIBLE FOR GARDENS, OR THE ESTATE MANAGER, MUST APPROVE A PLANTING PLAN BEFORE WORK IS UNDERTAKEN.
    e. THE PRIVATE OPEN SPACE MAY NOT BE FENCED.  THE WORD “FENCE” INCLUDES UTILISING THICK SHRUBS SUCH THAT THE AREA CANNOT BE VIEWED OR ENJOYED BY OTHERS.
    f. IF THE PROPERTY IS EVER SOLD, THE NEW OWNER MUST BE MADE AWARE OF THESE CONDITIONS.
  4. PERMISSION MUST BE OBTAINED FROM THE TRUSTEES FOR THE ERECTION OF GARDEN SHEDS OR SIMILAR STRUCTURES ON YOUR PROPERTY.
  5. THE TRUSTEE RESPONSIBLE FOR THE GARDENS MUST APPROVE ANY FENCING ERECTED IN TERMS OF SECTION 4.3 OF THE DESIGN MANUAL.
  6. ALL SWIMMING POOLS MUST BE ENCLOSED IN ACCORDANCE WITH MUNICIPAL REGULATIONS – SEE ALSO RULE 20 BELOW.
  7. WHERE PRIVATE OPEN SPACE HAS BEEN INCORPORATED INTO PRIVATE GARDENS, THE TRUSTEES RESERVE THE RIGHT TO EMPLOY A LAND SURVEYOR AT THE OWNERS OWN COST TO RE-ESTABLISH THE APPROPRIATE BOUNDARY PEGS.
RULE 8: TENNIS COURT
  1. BOOKINGS FOR THE TENNIS COURT ARE TO BE MADE AT THE GATEHOUSE.
  2. A MAXIMUM OF 2 HOURS IS PERMITTED PER DAY PER OWNER, AND MAY BE BOOKED A WEEK IN ADVANCE.
  3. ONLY ONE ADVANCE BOOKING MAY BE MADE AT A TIME.
  4. OTHERWISE THE COURT IS AVAILABLE ON A FIRST COME FIRST SERVED BASIS.
  5. DO NOT USE THE TENNIS COURT WITHOUT TENNIS SHOES.
  6. REMOVE ALL LITTER FROM THE TENNIS COURT AND SURROUNDING AREAS WHEN LEAVING.
  7. DOGS ARE NOT ALLOWED ON THE TENNIS COURT.
  8. DO NOT JUMP OVER THE NET OR FENCES.
RULE 9: VISITORS / STAFF
  1. SHOULD YOU BE PLANNING A FUNCTION AT YOUR HOME THAT MIGHT AFFECT PARKING OR YOUR NEIGHBOURS, YOU NEED TO NOTIFY THE ESTATE MANAGER AT LEAST A WEEK BEFORE THE TIME TO ENSURE THAT THE PROCESS CAN BE MANAGED PROPERLY IN TERMS OF THE ESTATE RULES AND SECURITY PROCEDURES.
  2. ALL VISITORS MUST REPORT TO THE GATEHOUSE AND WILL ONLY BE ADMITTED ONCE THE RESIDENT HAS BEEN CONTACTED, UNLESS THE RESIDENT HAS GIVEN PRIOR WRITTEN AUTHORISATION. (WE PARTICULARLY REQUEST THIS BE DONE WHERE YOU ANTICIPATE A LARGE NUMBER OF VISITORS TO AVOID CONGESTION AT THE GATE).  THE CONDUCT OF THE VISITOR REMAINS THE RESPONSIBILITY OF THE RESIDENT AT ALL TIMES.
  3. GUESTS STAYING ON A LONGER-TERM BASIS MUST BE COMMUNICATED IN WRITING TO THE GATEHOUSE STAFF.
  4. THE TRUSTEES, SECURITY AND THE ESTATE MANAGER RESERVE THE RIGHT TO REFUSE ACCESS TO ANY VISITOR UNDER THE INFLUENCE OF ALCOHOL/DRUGS, OR WHERE THEY BELIEVE THERE IS A RISK TO THE SAFETY OF A RESIDENT OR THE ESTATE.
RULE 10: BUILDING AND CONTRACTORS
  1. ANY RESIDENT PLANNING ANY FORM OF MAINTENANCE OR BUILDING WORK.I.E. LANDSCAPING/GENERAL MAINTENANCE AND ALTERATIONS MUST NOTIFY ESTATE MANAGEMENT IN WRITING PRIOR TO COMMENCING.
  2. A COMPREHENSIVE SET OF REGULATIONS FOR BUILDING/LANDSCAPING CONTRACTORS (AND THEIR SUPPLIERS AND SUB- CONTRACTORS) IS AVAILABLE FROM THE ESTATE MANAGER. 
  3. ALL BUILDING/LANDSCAPING CONTRACTORS ARE REQUIRED TO SIGN THAT THEY WILL COMPLY WITH THESE REGULATIONS PRIOR TO COMMENCING ANY CONTRACT. 
  4. A BUILDING DEPOSIT WILL BE REQUIRED, (THIS INCLUDES LANDSCAPING/GENERAL MAINTENANCE/ALTERATIONS OR SWIMMING POOLS), AND MUST BE LODGED WITH THE ESTATE MANAGER BEFORE ANY WORK COMMENCES.
RULE 11: SELLING/LETTING OF PROPERTY
  1. ESTATE MANAGEMENT MUST BE INFORMED WHEN A PROPERTY HAS BEEN SOLD OR LET, GIVING THE NAME AND DATE WHEN THE NEW OWNER/TENANT WILL OCCUPY THE PREMISES FOR SECURITY/ACCESS PURPOSES.
  2. WHEN SELLING YOUR HOUSE, NO “FOR SALE” OR “TO LET” SIGNS MAY BE DISPLAYED WITHIN THE ESTATE OR AT THE GATEHOUSE.
  3. SELLING/LETTING AND VIEWING IS BY APPOINTMENT ONLY.
RULE 12: LETTING
  1. ALL TENANTS AND OTHER PERSONS GRANTED RIGHTS OF OCCUPANCY BY ANY OWNER ARE OBLIGED TO COMPLY WITH THE CONSTITUTION AND THESE CONDUCT RULES, NOTWITHSTANDING ANY PROVISION TO THE CONTRARY CONTAINED IN ANY LEASE OR ANY GRANT OF RIGHTS OF OCCUPANCY.
  2. AN OWNER OF A HOUSE SHALL:
    a. BE RESPONSIBLE FOR ALL LEVIES, WATER, FEES, PENALTIES, LEGAL FEES INCLUDING ATTORNEY/CLIENT COSTS, FINES OR COST OF DAMAGE CAUSED BY THE OCCUPANT, TENANT OR THEIR GUESTS, INVITEES, EMPLOYEES AND CONTRACTORS.
    b. BE RESPONSIBLE FOR ENFORCING THE CONDUCT OF ANY OCCUPANT, TENANT OR THEIR GUESTS, INVITEES, EMPLOYEES AND CONTRACTORS.
    c. ENSURE THAT THE OCCUPANTS / TENANTS, THEIR GUESTS AND INVITEES AND EMPLOYEES AND CONTRACTORS ADHERE TO THE RULES.
    d. INFORM THE OCCUPANT / TENANT THAT SHOULD THEY PERSIST IN BREAKING THE RULES AND BEHAVING IN AN UNACCEPTABLE MANNER THEY WILL BE DENIED ACCESS TO THE ESTATE UNTIL THE MATTER IS SATISFACTORILY RESOLVED.
    e. NOTIFY THE TRUSTEES C/O THE ADMINISTRATOR IN WRITING NOT LESS THAN 5 DAYS PRIOR TO THE COMMENCEMENT OF A LEASE OF HIS HOME OF:
    i. THE FULL NAMES OF HIS TENANT, CONTACT DETAILS AND THE PERIOD OF THE LEASE
    ii. THE FULL NAMES AND CONTACT DETAILS OF ANY LETTING AGENT.
    f. NOTIFY THE TRUSTEES C/O THE ADMINISTRATOR IN WRITING NOT LESS THAN 5 DAYS PRIOR TO THE COMMENCEMENT OF A LEASE OF HIS HOME OF WRITTEN CONFIRMATION THAT :
    i. THE TENANT HAS BEEN HANDED A COPY OF THE CONSTITUTION AND THE CONDUCT RULES.
    ii. THE TENANT IS AWARE THAT HE IS BOUND BY THE CONSTITUTION AND THE CONDUCT RULES.
    g. COPIES OF THE CONDUCT RULES & THE CONSTITUTION ARE AVAILABLE FROM THE ADMINISTRATOR AT A COST OF R75.00 EACH.
RULE 13: ADVANCE PROVISION OF INFORMATION ABOUT TENANTS
  1. NO OWNER SHALL ALLOW ANY TENANT ACCESS TO THE ESTATE UNTIL A FORM IN A FORMAT TO BE PRESCRIBED BY THE TRUSTEES FROM TIME TO TIME HAS BEEN COMPLETED AND DELIVERED TO THE OFFICES OF THE ADMINISTRATOR AND TO THE SECURITY STAFF AT THE GATEHOUSE.   THE FORM SHALL REQUIRE DISCLOSURE OF THE IDENTITY OF EVERY PERSON WHO IS TO BE PERMITTED ACCESS TO THE ESTATE IN ACCORDANCE WITH THE TENANCY AGREEMENT, A DESCRIPTION OF THE RESIDENCE WHICH THE PERSON WILL BE ENTITLED TO OCCUPY AND THE PERIOD FOR WHICH SUCH OCCUPATIONAL RIGHTS WILL ENDURE AS WELL AS SUCH OTHER INFORMATION AND CONFIRMATIONS AS THE TRUSTEES MAY REASONABLY REQUIRE.
  2. THE SECURITY STAFF EMPLOYED BY THE HOMEOWNERS’ ASSOCIATION WILL BE ENTITLED TO ENQUIRE FROM ANY PROSPECTIVE VISITOR TO THE ESTATE THE PURPOSE OF THEIR VISIT AND TO REFUSE ACCESS TO ANY PERSON WHO, IN THEIR OPINION, APPEARS TO BE A SHORT OR LONG TERM TENANT WHOSE DETAILS HAVE NOT BEEN PROVIDED ON THE PRESCRIBED FORM.
RULE 14: COMMERCIAL ACTIVITIES ON RUYTEPLAATS
  1. RUYTEPLAATS IS A PRIVATE RESIDENTIAL ESTATE AND BUSINESS/COMMERCIAL ACTIVITIES OF HOMEOWNERS ON THE ESTATE ARE NOT PERMITTED.
  2. NO GUESTHOUSES ARE ALLOWED ON THE ESTATE.
  3. FILM / PHOTO SHOOTS BY COMMERCIAL TEAMS ARE NOT ALLOWED ON RUYTEPLAATS ESTATE.
RULE 15: ENTRY TO DAM AREA
  1. NO CHILDREN ARE ALLOWED AT THE DAM UNLESS ACCOMPANIED BY A RESPONSIBLE ADULT.
  2. NO DOGS ARE ALLOWED AT THE DAM.
  3. NO SWIMMING OR THROWING OF OBJECTS INTO THE WATER AT THE DAM IS PERMITTED.
  4. NO FISH MAY BE ADDED TO OR REMOVED FROM THE DAM
  5. PLEASE KEEP THE GATE CLOSED AT ALL TIMES
  6. PLEASE REMOVE YOUR LITTER WHEN LEAVING THE DAM AREA.
RULE 16: ASSOCIATION EMPLOYEES
  1. A RESIDENT SHALL NOT:
    a. INSTRUCT ANY EMPLOYEE OF THE HOMEOWNERS’ ASSOCIATION WHICH INCLUDES ANY EMPLOYEE, CONTRACTOR OR THE ADMINISTRATOR.
    b. DISPLAY RUDE OR AGGRESSIVE BEHAVIOUR TO SUCH EMPLOYEES.
    c. REQUEST PERSONAL DUTIES TO BE PERFORMED BY ANY MEMBER OF STAFF EMPLOYED BY THE ASSOCIATION DURING NORMAL WORKING HOURS, INCLUDING LUNCH BREAKS.
RULE 17: TRANSGRESSION OF THE RULES
  1. PLEASE REPORT ANY TRANSGRESSION OF THE RULES TO THE TRUSTEES, IN WRITING, VIA THE ADMINISTRATOR, CAPE CLASSIC PROPERTY SOLUTIONS ON FAX (021) 787 9910 OR BY EMAIL TO INFO@CAPECLASS.CO.ZA.  IN ADDITION, WHERE IMMEDIATE ACTION IS REQUIRED, PLEASE REPORT THE TRANSGRESSION TO THE ESTATE MANAGER WHO WILL TAKE APPROPRIATE ACTION.
  2. THE TRUSTEES RESERVE THE RIGHT TO IMPOSE PENALTY FINES IN TERMS OF THE CONSTITUTION, FOR REPEAT OR SERIOUS TRANSGRESSION OF THE REGULATIONS.   FINES WILL BE IMPOSED AT THE DISCRETION OF THE TRUSTEES, AND WHERE ANY INCIDENT IS ONGOING, THIS SHOULD NOT BE TREATED AS A SINGLE INCIDENT, BUT WILL BE PENALISED ON A DAILY BASIS AND AS LONG AS THE OFFENCE CONTINUES, THE PENALTY WILL BE IMPOSED FOR EACH DAY THAT THE OFFENCE IS REPEATED.
  3. THE TRUSTEES DECISION IS FINAL AND NO CORRESPONDENCE WILL BE ENTERED INTO.   ANY EXPENSES INCURRED IN THE ADMINISTRATION OF BREACHES OF THE RULES WILL BE FOR THE ACCOUNT OF THE OFFENDER.
RULE 18: SUPERVISION OF POTENTIALLY DANGEROUS BEHAVIOUR
 
RESIDENT AND VISITORS SHALL ENSURE THEIR CHILDREN UNDER THE AGE OF FOURTEEN YEARS ARE REASONABLY SUPERVISED WHEN PLAYING ON THE COMMON PROPERTY AND THAT THEY DO NOT ENGAGE IN ANY POTENTIALLY DANGEROUS ACTIVITIES.
 
RULE 19: ANTI-SOCIAL BEHAVIOUR / NOISE
  1. IN THE INTERESTS OF PROPER DECORUM THE TRUSTEES HAVE FORMULATED THE FOLLOWING GUIDELINES WITH REGARD TO “ANTI-SOCIAL BEHAVIOUR”:
  2. a. NO PERSON SHALL MAKE AN EXCESSIVE AMOUNT OF NOISE SUCH THAT HIS NEIGHBOURS SHALL HAVE CAUSE FOR COMPLAINT.
    b. ALL RESIDENTS ON THE ESTATE SHALL ENSURE THAT THEIR RESPECTIVE ACTIVITIES IN AND USE OF THE COMMON PROPERTY AND OF THE ERF OR ANY PART THEREOF WITH ALL SERVICES, FACILITIES AND AMENITIES AVAILABLE ON THE COMMON PROPERTY SHALL AT ALL TIMES BE CONDUCTED AND CARRIED OUT WITH REASONABLE AND DILIGENT CARE AND WITH DUE AND PROPER CONSIDERATION FOR THE REMAINING RESIDENTS OF THE OTHER HOUSES AND IN ACCORDANCE WITH THESE RULES, AND ANY HOUSE RULES MADE IN TERMS OF THESE RULES.
    c. THIS RULE SHALL LIKEWISE APPLY TO GUESTS AND EMPLOYEES OF THE OWNERS AND/OR OCCUPANTS OF SECTIONS WHILST THEY ARE IN ANY ERF AND/OR THE COMMON PROPERTY.
    d. AN OWNER OR OCCUPIER SHALL NOT CAUSE OR PERMIT ANY DISORDERLY CONDUCT OF WHATSOEVER NATURE UPON THE ERF OR ANY PART OF THE COMMON PROPERTY OR DO OR PERMIT ANY ACT, MATTER OR THING IN OR ABOUT THE SAME WHICH SHALL CONSTITUTE OR CAUSE A NUISANCE OR DISTURBANCE OR ANY INCONVENIENCE TO ANY OTHER OWNER OR OCCUPANT OF ANY ERF IN THE QUIET ENJOYMENT OF THEIR OWN PREMISES OR WHICH IS LIKELY TO OR IN ANY WAY TEND TO AFFECT DETRIMENTALLY THE BENEFIT, ENJOYMENT, RIGHTS OF OCCUPATION OR THE INTEREST OF ANY OTHER OWNER OR OCCUPANTS OF ANY OTHER ERF OR MEMBER OF THE HOMEOWNERS’ ASSOCIATION.
    e. ALL COMPLAINTS REGARDING THE BEHAVIOUR OF ANY OCCUPANT SHALL BE DIRECTED BY THE TRUSTEES OR THE ADMINISTRATOR TO THE OWNER OF THAT ERF.
RULE 20 : SWIMMING POOLS – SAFETY AND ENCLOSURES AS PER THE NATIONAL BUILDING REGULATIONS
  1. THE OWNER OF ANY SITE WHICH CONTAINS A SWIMMING POOL SHALL ENSURE THAT ACCESS TO SUCH A SWIMMING POOL IS CONTROLLED.
  2. NO PERSON CAN HAVE ACCESS TO SUCH A SWIMMING POOL FROM ANY STREET OR WALL OR FENCE OTHER THAN A SELF-CLOSING AND SELF-LATCHING GATE.
  3. SUCH WALL OR FENCE OR ANY GATE THEREIN SHALL BE NOT LESS THAT 1.2M HIGH MEASURED FROM THE GROUND LEVEL, AND SHALL NOT CONTAIN ANY OPENING WHICH WILL PERMIT THE PASSAGE OF A 100MM DIAMETER BALL.
